The Brooklyn Monarch, The Meadows, and The Woodshop - Acknowledgment of Assumption of Risk & Release of Liability Regarding Live Events

THE PURCHASER (Hereafter referred to as THE UNDERSIGNED), ACKNOWLEDGES THAT ATTENDANCE AT, AND/OR PARTICIPATION IN A LIVE EVENT IS A HIGHLY RISKY UNDERTAKING WITH THE POSSIBILITY OF SERIOUS INJURY OR DAMAGE. It is not a typical entertainment or sporting Event but may include bodily contact with the purchaser or others that can cause bodily harm. THE UNDERSIGNED AGREES THAT HE/SHE IS ASSUMING THE RISKS in attending and/or participating in such Event, which was arranged or leased through 23 Meadow LLC- a New York based Limited Liability Company at a facility and/or property leased and/or permitted by, or serviced by, said Limited Liability Company at 23 Meadow Street Brooklyn, New York (also known as Brooklyn Monarch or Monarch.) The undersigned also agrees that entry into any Event is conditioned on a search for drugs, weapons including phosphorus, devices, fireworks, stink bombs and the like- and the undersigned agrees to such searches and waives any liability for the same, and the confiscation of weapons and/or drugs, or similar duress- as mentioned heretofore. The undersigned also agrees that he/she may not engage or join in any political protests or display of symbols targeting any political parties or States or Nationalities or any discriminating remarks or symbols defined as discriminatory – under New York and Federal Law, or to write or encourage or rioting or such practices, at the premises where the Event is taking place, or in the vicinity thereof.
THIS DOCUMENT IS ALSO A RELEASE AND WAIVER OF LIABILITY, AND AN INDEMNITY AGREEMENT WITH A COVENANT NOT TO SUE 23 MEADOW LLC which also does business as Monarch or its Members, officers, directors, managers and employees, (all of the aforesaid referred hearing after as “THE RELEASEES”), FROM ANY AND ALL LOSS OR DAMAGES, OR ANY CLAIM, OR ANY INJURY OR DAMAGE to the person or property of the undersigned, arising out of, or related to, directly or indirectly, in attending, being present, or participating, in any of the Events at THE MONARCH , or in the vicinity of such Events.
The undersigned hereby agrees to indemnify and hold harmless the Releasees from any and all loss, liability, damage, or costs or injury, (including attorneys’ fees and court costs) that the Releases may incur, or arising out of, or relating to attending or participating in any manner, to the Events at THE MONARCH, or any vicinity thereof.
Notwithstanding this RELEASE and INDEMNITY AGREEMENT to the RELEASEES, which shall not be deemed diminished by the additional clauses and terms attached and made a part hereof, the undersigned agrees that he or she will obey and observe all posted notices, announcements, warnings, admonitions, issued by the Releasees, and all their staff, and security employees (without any obligation on their part to provide such admonitions, warnings, notices or security; or directions,) whether posted or given orally as rules or directions whether posted or announced, to the undersigned, and/or to any co-attendant, or any companion of the undersigned in the presence or hearing distance of the undersigned.
The undersigned acknowledges that without executing this Release, Waiver and Indemnity Agreement, the undersigned would not have been permitted to attend, or to view, or to participate in any Event taking place at THE MONARCH or its vicinity. That, in consideration of the undersigned executing this Release and Waiver and Indemnity Agreement, and to comply with all its requirements, entry was given to the undersigned to the Event, but only at the undersigned’s RISK, said risk being taken by the undersigned without blaming anyone except him or herself. The undersigned also acknowledges that any security personnel’s, Announcement or Warning given by the Releases, (without any obligation on part,) was given solely for the Releasees’ own protection of their property and the Releasee’s personal safety. The undersigned also acknowledges and agree to pay for any damages to the Monarch’s facility and/or property, or to the staff and employees of the facility, and NOT as an obligation to be undersigned or to any of the participants or attendees present at such Events.
This agreement and each of its terms are the product of an arm’s length Negotiation between the parties. If any ambiguity is found to exist, or is existent in the interpretation of this agreement, each of the parties agree that the terms and conditions in this agreement were jointly drafted and discussed and negotiated jointly, and explicitly Reject the Law of Construction interpreting a contract or any of its provisions against the draftsman of this agreement and waive any such Rule of Construction.
